1.About these terms
These terms form an agreement between you and Shivtensity Private Limited ("we", "us"), which operates BetterSleep and delivers the Better Sleep Program with Dr. Shivli. By booking, paying for, or taking part in the programme, you accept these terms.
If you do not agree with any part of these terms, please do not enrol. If something here is unclear, ask us before you pay.
2.What the programme is
The Better Sleep Program is a psychology-led, behavioural sleep programme. Depending on your needs it may include:
- A Sleep Pattern Assessment
- A personalised sleep report
- One-to-one consultations
- Individualised weekly sleep plans
- Activities, worksheets and curated resources
- Support between sessions over WhatsApp or email
- A follow-up session after the core programme
Sessions are usually delivered remotely by video call unless agreed otherwise. The programme adapts to your situation, so the exact mix of the above will vary from person to person.
3.Not medical advice
The programme is behavioural and educational. It does not constitute medical advice, diagnosis or treatment, and it does not replace assessment or care from a physician, psychiatrist or sleep specialist.
We do not prescribe, alter or withdraw medication. Never start, stop or change a prescribed medication because of anything discussed in the programme — speak to the prescribing clinician.
If your history suggests you may need medical or specialist evaluation — for example possible sleep apnoea, restless legs, narcolepsy, or a condition better addressed clinically — we will tell you and may recommend you seek that assessment. We may decline to continue if we believe the programme is not appropriate for you.
4.Emergencies and crisis support
This is not a crisis or emergency service. We do not monitor messages continuously and cannot provide urgent care.
If you are in immediate danger or thinking about harming yourself, contact your local emergency services now. In India you can also reach Tele-MANAS on 14416 or KIRAN on 1800-599-0019, free and available 24/7. Please also tell someone you trust.
5.No guaranteed outcome
Sleep does not follow a fixed timeline and every person responds differently. We do not promise that you will sleep a particular number of hours, that results will arrive within a set period, or that every night will be restful.
What we commit to is a structured process: understanding your sleep, introducing targeted changes, and adjusting based on how you respond. Nothing on this website should be read as a guarantee of a specific result.
6.Eligibility
You must be 18 or older to enrol on your own behalf. If you are under 18, a parent or legal guardian must arrange the programme and provide consent.
You must be able to take part in sessions in a private setting with a stable internet connection.
7.Your responsibilities
For the programme to work, you agree to:
- Give accurate and complete information in your assessment and sessions
- Disclose relevant diagnoses, medications, substance use and any care you are receiving elsewhere
- Tell us promptly if your health, medication or circumstances change
- Use the strategies discussed at your own discretion and judgement
- Attend sessions on time and communicate if you cannot
Withholding relevant health information may make the programme ineffective or unsuitable, and limits our ability to help you safely.
8.Sessions, scheduling and communication
Sessions are scheduled by mutual agreement. To reschedule without forfeiting a session, give at least 24 hours notice. Cancellation and missed-session rules are set out in our Refunds & Cancellation Policy.
Between-session support is provided over WhatsApp or email during working hours. We aim to reply within 3 working days. It is for questions, updates and scheduling — not for urgent or crisis matters.
You may not record, photograph or livestream sessions without our prior written consent. We do not record sessions unless we have asked for and received your consent.
9.Confidentiality and its limits
What you share is treated as confidential and handled as described in our Privacy Policy. There are narrow situations where we may need to disclose information without your consent:
- Where there is a serious and imminent risk to your life or safety, or to someone else
- Where a child or vulnerable person may be at risk of harm
- Where we are compelled by law, a court order or a regulatory authority
Where disclosure becomes necessary, we will share the minimum required and, wherever it is safe and practical, discuss it with you first.
10.Fees and payment
Fees are quoted in INR and are payable in advance unless we agree otherwise in writing. The programme begins once payment is received and you have completed the Sleep Pattern Assessment.
Payments are handled by a third-party payment provider. We do not receive or store your full card details. Where taxes apply, they will be shown at checkout or on your invoice.
11.Programme materials and intellectual property
Your report, plans, worksheets and curated resources are prepared for your personal use. All content on this website and within the programme remains our intellectual property.
You may not resell, publish, distribute or share programme materials, or use them to deliver a service to others, without our written permission.
12.Ending the programme
You may stop at any time; refund entitlements are set out in our Refunds & Cancellation Policy.
We may pause or end the programme if you are abusive towards us, repeatedly miss sessions without contact, breach these terms, or if we conclude the programme is not clinically appropriate for you. Where we end it for reasons other than your breach, we will refund fees for undelivered sessions.
13.Limitation of liability
To the fullest extent permitted by law, our total liability arising from the programme is limited to the fees you paid for it. We are not liable for indirect or consequential losses, including lost income or opportunity.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
14.Changes to these terms
We may update these terms from time to time. The version in force when you paid is the version that governs your programme. Continued use of the website after an update means you accept the revised terms.
15.Governing law
These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of Raipur, Chhattisgarh.
We would much rather resolve a concern directly. Please contact us first and we will make a genuine effort to sort it out.
